Lucky Wholesale respects intellectual property rights and expects our customers to do the same. Please review this policy carefully before submitting or purchasing any designs.
What Is a Copyrighted Design?
A copyrighted design includes any artwork, logo, character, phrase, or image that is legally owned by an individual, brand, company, organization, or league and protected under copyright or trademark law.
If you did not create the design yourself and do not have written permission or a valid commercial license, the design is likely copyrighted.
Examples of Copyrighted Content (Not Allowed Without Authorization)
The following are not permitted unless you have proper legal rights or written authorization:

Movie, TV, cartoon, or anime characters

Sports teams, leagues, mascots, names, or logos

Brand logos, brand names, or slogans

Music artists, band names, album artwork, or song lyrics

Celebrities’ names, likenesses, or photographs

College or university names, logos, or mascots
If a design is recognizable from entertainment, sports, or major brands, it is almost always copyrighted.
How Can I Tell If a Design Is Copyrighted?
A design is likely copyrighted if:

You recognize it from TV, movies, sports, or major brands

It includes logos, mascots, or brand names

It appears on official merchandise

Permission would normally be required to sell it
Changing colors, fonts, or minor details does not remove copyright protection.
What If I Designed It Myself?
Creating a design yourself does not make it legal if the subject matter is copyrighted.
Examples:

Drawing a cartoon character yourself → still copyrighted

Recreating a sports logo → still copyrighted

Typing a team name in a new font → still copyrighted
Do You Offer Custom Design Services?
Lucky Wholesale does not offer custom design creation services.
If you already have a completed design that you legally own or have rights to, we can print and resize it as requested.
What If I Purchased the Design From Etsy or Another Platform?
Purchasing a design from Etsy or similar platforms does not automatically grant commercial rights.
Please note:

Many sellers do not own the original rights

A design being sold does not make it legal

Third-party licenses do not override copyright or trademark law
If the design includes copyrighted characters, brands, or teams, it may still be illegal to use.
Responsibility for Copyright Compliance
The customer is fully responsible for ensuring they have the legal right to use any submitted artwork.
By submitting artwork to Lucky Wholesale, you confirm that:

You have proper written permission or a valid commercial license
Lucky Wholesale is not responsible for any legal claims, fines, damages, or losses resulting from copyright or trademark violations.
Possible Legal Consequences of Copyright Violations
Violations may result in:

Cease-and-desist notices

Lawsuits or financial penalties
-
Platform bans (Shopify, Etsy, Amazon, etc.)
-
Forced product or listing removal
These consequences may apply even if the violation was unintentional.
Design Review & Refusal Rights
Lucky Wholesale does not provide legal approval or verification of artwork.
We reserve the right to refuse any design that clearly violates copyright or trademark laws, but final legal responsibility remains with the customer.
